By accessing and using Collage Maker ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Collage Maker is a web-based application that allows users to create photo collages using images stored locally in their browser. The Service operates entirely client-side, with all image processing happening in your browser using IndexedDB for storage.

Optional features include integration with Google Photos for importing images. This integration requires user authentication through Google OAuth and operates under Google's terms of service.

3. User Responsibilities

You agree to:

• Use the Service only for lawful purposes
• Not upload or use images that violate copyright, trademark, or other intellectual property rights
• Not upload or use images containing illegal, offensive, or inappropriate content
• Not attempt to circumvent any security features of the Service
• Not use the Service in any way that could damage, disable, or impair the Service
• Ensure you have the right to use any images you upload or import

4. Privacy and Data Storage

Your photos and collages are stored locally in your browser's IndexedDB storage. We do not have access to, store, or process your images on our servers. For more information about data handling, please review our Privacy Policy.

5. Intellectual Property

You retain all rights to images you upload or create using the Service. We do not claim any ownership rights to your content. However, you grant us a limited license to display your images within your browser as necessary to provide the Service functionality.

All code, design, graphics, and other materials related to the Service (excluding user content) are owned by Collage Maker and protected by intellectual property laws.

6. Third-Party Services

The Service integrates with the following third-party services:

• Google Photos API: Optional integration for importing photos. Subject to Google's terms of service and privacy policy.
• Google AdSense: We display advertisements through Google AdSense. Subject to Google's advertising policies.

We are not responsible for the practices or policies of these third-party services.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• Your data stored in IndexedDB will be preserved (browser data can be cleared)
• The Service will meet your specific requirements
• Any errors or defects will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLLAGE MAKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Loss of data stored in your browser
• Unauthorized access to your browser storage
• Any other matter relating to the Service

9. Data Loss

Since all data is stored locally in your browser's IndexedDB, you acknowledge and agree that:

• Clearing browser data will permanently delete your images and collages
• We cannot recover deleted data
• You are responsible for exporting and backing up any collages you wish to keep
• Browser storage limits may prevent you from storing large numbers of images

10. Modifications to Service

We reserve the right to modify or discontinue the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

11. Modifications to Terms

We reserve the right to update these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the modified terms.

12. Termination

We reserve the right to terminate or suspend access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

You may stop using the Service at any time. Upon termination, you should clear your browser data if you wish to remove all stored images and collages.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
